In certain circumstances, a foreign national will be detained by the Canada Border Services. This can happen for a number of reasons, such as non compliance with a set of conditions set out by the CBSA or staying in Canada without proper authorisation.

Initial Detention Hearing is held within the first 48 hours of detention. You will not get another Detention Hearing for seven days after that and every 30 days subsequent to the 7 day detention review.

 The Minister's Counsel is present at the Proceedings in order to present a case against the detainee and convince the Decision Maker (in this case a Board Member of the Immigration Division) to continue the detention. Our job will be to convince the Board Member to release the detained person by making a case for her.
