Who Can Apply for Refugee Protection in Canada?
Not everyone qualifies for refugee status in Canada. The government protects two main groups of people:
Convention Refugees are individuals who are outside their home country and have a real reason to fear persecution. This could be due to their race, religion, nationality, political beliefs, or because they belong to a certain group within society.
Persons in Need of Protection are those already in Canada who cannot return to their home country because they would be at risk of torture, severe punishment, or even death.
How and Where to Make a Refugee Claim
There are two ways to start your claim:
At a Port of Entry: This means at the airport, land border, or seaport when you first arrive in Canada.
From Inside Canada: If you’re already in the country, you can submit your application through the Immigration, Refugees and Citizenship Canada online system.
In both cases, one of the most important parts of the process is filling out the Basis of Claim (BOC) form. This is where you share your personal story and explain why you are afraid to go back to your home country. It’s critical that this form is filled out truthfully, clearly, and on time.
What Happens at the Refugee Hearing
Once your claim is submitted, you will be given a date to appear before the Immigration and Refugee Board (IRB). This hearing gives you a chance to tell your story in your own words and provide proof of the dangers you face.
